This page governs your use of this website. It is deliberately short on the things that do not matter and specific about the two that do: that asking us for a price commits neither of us to anything, and that the work itself is governed by what you and we sign rather than by anything published here.

If a term here is unclear, please ask before relying on it.

1. Acceptance of These Terms

This website is operated by Clark Painting & Drywall, LLC ("we", "us", or "our"). By using it, you agree to these terms. If you do not agree with them, please do not use the site.

These terms govern your use of this website. They do not govern work we carry out for you. Work is governed by the written proposal, contract, and related documents you and we sign, and where those documents and this page differ, those documents control.

2. Using This Website

You are welcome to read this website, to share links to it, and to use the forms on it to get in touch with us. We ask only that you use it lawfully and that you do not interfere with it or with anybody else's use of it.

We try to keep the site available and working, but we do not undertake that it will be available without interruption. We may change, suspend, or withdraw any part of it, and we may do so without notice.

3. The Information on This Website

Everything on this website is provided for general information. It describes the kind of work we do, how we approach it, and roughly what to expect — and it is written to be accurate rather than flattering.

It is not a quotation, an offer, a warranty, or professional advice about your particular property. Descriptions of services, approaches, timing, materials, and the areas we serve are general, and the right answer for your project depends on the property, the substrate, the season, and what you want, none of which a web page can know.

We may change what is on the site at any time, and we do not undertake to keep every page current. Nothing here creates a right to have work done in a particular way, at a particular price, or by a particular date.

4. Estimate Requests and Enquiries

Sending an Estimate Request, a message through the Contact page, or an enquiry by any other means does not create a contract between us, and it does not oblige either of us to anything.

  • Submitting a form does not commit us to carrying out work, to a price, or to a schedule.
  • Submitting a form does not commit you to anything either. You are asking a question, and you are free to stop there.
  • An estimate or a figure discussed in conversation, by telephone, or by email is an indication and not a fixed price.
  • We may decline a project. We may decline it because it is outside the area we work in, outside what we do well, or because our schedule cannot accommodate it, and we will say which.

Work begins when you and we have agreed it in writing. Until then, nothing has been agreed.

5. Written Proposals Govern the Work

When we agree to carry out work, the terms of that work are set by the documents we exchange and sign — not by this website and not by anything said in passing.

The written proposal
Defines what is included, what is not, the materials and finishes, the price, and the basis on which the work is scheduled. It is the document that matters.
The contract or work agreement
Where one is used, it governs payment, access, responsibilities, and how either of us may bring the arrangement to an end.
Change orders
Any change to scope, materials, price, or schedule after work is agreed should be recorded in writing and agreed by both of us before it is carried out.
Any written warranty
Where we give one, its own terms, duration, and exclusions apply. Nothing on this website extends, varies, or adds to a warranty.

Where anything on this website conflicts with a signed document, the signed document controls. Where something is not covered by a signed document, please ask us rather than assume the website answers it.

6. Pricing and Scheduling

Painting and drywall are priced on the work in front of us. Two rooms of the same size can differ substantially once the condition of the surfaces, the preparation required, the access, and the finish specified are taken into account.

For that reason:

  • Prices are set in a written proposal for a specific project, after we have seen it.
  • A proposal is open for acceptance for the period stated on it, and material or labour costs may change after that.
  • Conditions discovered once work begins — hidden damage, previous work that has to be corrected, a substrate that will not hold a finish — may change the scope and the price, and we will tell you before we proceed rather than afterwards.
  • Schedules are estimates made in good faith. Exterior work in particular depends on weather and temperature, and we would rather move a date than apply a coating in conditions that will shorten its life.

Where a delay is outside our control, we will keep you informed and reschedule as promptly as we reasonably can.

7. Intellectual Property

The design, layout, text, graphics, and arrangement of this website belong to us or to those who licensed them to us, and are protected by copyright and other laws.

You may read the site, print a page for your own reference, and share a link to it. You may not copy, republish, or reuse its text, photography, or design for commercial purposes, and you may not present any part of it as your own work.

Our name and logo are ours. Please do not use them to suggest an association, endorsement, or partnership that does not exist.

8. Photography and Project Imagery

Photographs on this website illustrate the standard of finish and the kind of work we do. Some are licensed from third parties, and images shown alongside a service, a category, or a description are illustrative rather than records of a particular job.

Please treat every image here as an example of a standard rather than as a promise of a specific result. Colour reproduction varies between screens, paint and stain read differently under different light, and a finish photographed in one property will not look identical in another.

Where we do publish a project of our own, we do so with the property owner's permission. We do not publish addresses, and we do not identify a client without asking.

9. What You Send Us

When you send us a message, an estimate request, an application, a photograph, or a document, you are responsible for what you send. By sending it you confirm that:

  • You are entitled to send it, and doing so does not infringe anybody's rights.
  • It does not contain anything unlawful, and it does not contain another person's private information that you have no right to share.
  • What you have told us is accurate as far as you know.

You keep ownership of what you send. You give us permission to use it for the purpose you sent it for — to answer you, to price and carry out work, or to consider your application — and for nothing else.

We will not publish your photographs, use them in our portfolio, or use them in advertising unless we ask you and you agree, separately and in writing. How we handle what you send is described in our Privacy Policy.

Please do not send us anything confidential or sensitive through this website. A web form is not the place for it, and a telephone call is better.

10. Prohibited Use

You agree not to:

  • Use this website for any unlawful purpose, or to encourage anybody else to.
  • Submit false information, impersonate anybody, or send a form on somebody else's behalf without their knowledge.
  • Send anything designed to damage a computer system, or attempt to gain access to any part of this site or its server that is not open to the public.
  • Interfere with the site's operation, or attempt to overwhelm it with automated requests.
  • Harvest addresses, telephone numbers, or other details from the site, whether by hand or by machine.
  • Use the forms on this site to send advertising, solicitations, or bulk messages.
  • Copy, frame, or mirror the site, or scrape it to build or train another product or service.

We may withdraw access to this website from anybody who does any of these things, and we may take whatever further steps are appropriate.

11. Links to Other Websites

This website may link to websites we do not operate — a manufacturer, a supplier, a trade association. We provide those links for convenience.

We do not control those sites, we do not endorse everything on them, and we are not responsible for their content, their accuracy, or how they handle your information. Once you follow a link away from here, that site's own terms and privacy policy apply.

12. Disclaimer of Warranties

This website and everything on it are provided as they are, and as available.

To the fullest extent the law allows, we make no warranties about this website — including that it will be uninterrupted, error-free, secure, or free of anything harmful, or that the information on it is complete, current, or suitable for your particular purpose.

This section is about the website. It does not affect any written warranty we give on work we have carried out, and it does not limit any right you have under the law that cannot be limited.

13. Limitation of Liability

To the fullest extent the law allows, we are not liable for any indirect, incidental, special, or consequential loss arising out of your use of this website, or out of your inability to use it. That includes lost profit, lost data, and loss arising from your reliance on information published here.

Nothing in this section limits our liability for death or personal injury caused by negligence, for fraud, or for anything else the law does not allow to be limited.

Our responsibility for work we have carried out is governed by the proposal, the contract, and any written warranty relating to that work — not by this section and not by this website.

14. Indemnification

You agree to indemnify us against claims, losses, and reasonable costs arising out of your use of this website in breach of these terms, or out of anything you send us that you were not entitled to send.

This does not apply to anything caused by us.

15. Governing Law and Venue

These terms are governed by the laws of the State of Alaska, without regard to conflict of law principles.

Any dispute arising out of these terms or out of your use of this website will be brought in the state and federal courts located in the State of Alaska, and you and we each agree to that.

We are based in Wasilla, Alaska, and we work in Alaska. This website is directed to people looking for work carried out there.

16. Changes to These Terms

We may update these terms. When we do, we will change the date at the top of this page, and the version published here is the one that applies.

Continuing to use the site after a change means you accept the updated terms. If a change matters to work already agreed, the signed documents for that work continue to govern it.

If any part of these terms turns out to be unenforceable, the rest continues to apply.
